CERTIFICATE OF NO IMPEDIMENT TO MARRIAGE

 

  • Certificates of No Impediment are issued to KENYAN CITIZENS wishing to have their marriages, either to Kenyan citizens or foreigners (Non-Kenyans) performed abroad. The Certificate conforms that the applicant is SINGLE and has the capacity to enter into marriage.
  • Every Kenyan wishing to marry abroad has to apply for a Certificate of No Impediment to Marriage from the nearest Kenyan Mission. The application is then forwarded to the Office of the Attorney General (State Law Office) in Nairobi, Kenya for processing.
  • Marriages conducted without issuance of this Certificate will neither be recognized by the Mission nor by the Authorities in Kenya.
  • All photocopies must be certified by a notary public. Scanned documents will not be accepted.
The following are the requirements to facilitate issuance of a Certificate of No Impediment to Marriage by the Attorney General’s Office in Kenya:-
  1. Application Form MA5MA5 to be duly completed.
  2. Valid Kenyan Passport for certification or Certified copy of Valid Kenyan Passport (certified by Notary Public).
  3. Copy of Residence Permit from Country of residence.
  4. Passport size photos- two each (white background).
  5. Copy of Death Certificate (if widow or widower).
  6. Copy of Kenya National I.D.
  7. Copy of Divorce Decree Absolute (If the partner had been married before & divorced)
  8. Sworn affidavit if the Death Certificate or Divorce Decree is more than 2 years.
  9. Certified copy of the Fiancé’s passport (From Embassy/Notary Public).
  10. Fee for Certificate of No Impediment: 30 KWD+ 4KWD (Authentication fee).
  11. Processing period is between Six (6) to Twelve (12) weeks.
  12. Appear in person to verify that you have the required document/pre-requisites and you meet the relevant criteria before you apply.

Processing: The certificate takes up to 3 months or more
